Terms of service

These terms govern your use of Scoreboard ("the app", "we", "us"), a Shopify app published by AskMario. By installing or using Scoreboard you agree to these terms.
1. The service
Scoreboard provides POS-staff sales-target tracking, commission calculation, incentives, broadcasts, leaderboards, and analytics for Shopify merchants. Features available to you depend on the subscription plan you've chosen.
2. Account
You install Scoreboard via the Shopify App Store, which authenticates and authorises the app on your behalf. You're responsible for actions taken in your shop's admin while Scoreboard is installed, and for keeping your shop's Shopify account secure.
3. Subscription & billing
- Scoreboard offers Free, Pro, Scale, and Enterprise tiers. Free is available indefinitely. Pro and Scale are billed monthly through Shopify's billing API. Enterprise is priced per contract — contact us if you need it.
- Pricing and what each tier includes is on the Settings page inside the app and on Shopify's app listing. We may change pricing for new subscriptions; existing subscriptions stay at the price they signed up at until you change tier.
- Upgrades take effect immediately. Downgrades and cancellations take effect at the end of the current billing period; Shopify prorates any unused portion as a credit.
4. Cancellation & refunds
You can cancel at any time from the Settings page inside the app or by uninstalling. On cancellation, you're moved to the Free tier; your data stays read-only until you resubscribe or uninstall. Refunds beyond Shopify's automatic proration are evaluated case by case — email us if there's an issue.
5. Acceptable use
Don't use Scoreboard to:
- Violate any law, regulation, or Shopify's terms.
- Reverse-engineer the app or attempt to access accounts you don't own.
- Send abusive, deceptive, or harmful content via broadcasts or staff names.
- Resell access without our written permission.
6. Data & privacy
Our handling of your shop's data is described in the Privacy policy. We never store customer personal information.
7. Intellectual property
Scoreboard's code, design, and brand are owned by AskMario. Your shop's data is owned by you. We hold no claim over the data you feed into the app.
8. Service availability
We aim for high availability but don't guarantee uptime. Scheduled maintenance, third-party outages (Shopify, Fly, Neon), and unforeseen events can cause downtime. We'll communicate material outages via the merchant contact email or app banner.
9. Limitation of liability
To the extent permitted by law, Scoreboard's liability is limited to the amount you paid in subscription fees during the 12 months preceding the event giving rise to the claim. We're not liable for indirect, incidental, or consequential damages (lost profits, missed sales, data unavailable during an outage, etc.).
10. Indemnification
You agree to indemnify and hold AskMario harmless from third-party claims, damages, and reasonable legal costs arising out of (a) your misuse of the app, (b) content you publish through Scoreboard (staff names, broadcast messages, incentive descriptions), or (c) your breach of these terms. We'll do the same in reverse if a third-party claim arises from our infringement of their intellectual property in the Scoreboard codebase.
11. Termination
Either party may terminate this agreement at any time. We may suspend or terminate access if you breach these terms or use the app in a way that risks the integrity of the service for others.
12. Changes
We may update these terms; the effective date at the top of this page reflects the latest revision. Material changes will be communicated via the merchant contact email on file. Continued use after a change indicates acceptance.
13. Governing law
These terms are governed by the laws of the Republic of South Africa, where AskMario is registered. Disputes will be resolved in the South African courts.
